REFUND AND CANCELLATION POLICY

This Refund & Cancellation Policy (“Policy”) governs all purchases, subscriptions, service requests, and transactions conducted on or through the Unaati platform (“Platform”). By accessing or using the Platform, the User expressly agrees to be bound by this Policy

1. General Disclaimer

1.1. The User acknowledges that the Platform provides digital tools, facilitation services, leads, advisory support, listings, and technology-driven features on an “as available” basis.
1.2. The Company’s obligations are limited solely to providing access to the Platform; the Company does not guarantee outcomes, conversions, business results, or fulfilment by third-party service providers.
1.3. Purchases made on the Platform are deemed final unless expressly stated otherwise.

2. User-Initiated Cancellations

2.1. Digital Services & Subscriptions
Because digital deliverables, credits, and subscriptions are activated instantly upon payment, no cancellation or refund shall be permitted under any circumstances, unless explicitly mandated by applicable law.

2.2. Third-Party Services / Partner-Led Services
Cancellation may be permitted only if the request is received before processing has commenced.

  • Once a request has been assigned, confirmed, or initiated with a partner, cancellation will not be allowed.

2.3. The Company’s decision regarding the status of service initiation shall be final and binding.

3. Cancellations by the Company

3.1. The Company reserves the absolute right to cancel a booking, subscription, or transaction at its sole discretion, including but not limited to:
(a) technical issues;
(b) pricing errors;
(c) suspected fraud or misuse;
(d) regulatory or operational constraints;
(e) incorrect or insufficient User information.

3.2. In such cases, the Company may, at its discretion, process a refund in accordance with Clause 4.
3.3. Such cancellation shall not render the Company liable for any consequential, incidental, indirect, or special losses suffered by the User.

4. Refunds

4.1. General Rule
All payments made for Platform access, digital services, leads, advisory information, SaaS tools, and subscriptions are strictly non-refundable.

4.2. Refunds for Third-Party Services
Where applicable and only if cancellation is accepted before initiation, the Company may process a partial refund after deducting:

  • administrative fees,

  • partner charges,

  • payment gateway fees,

  • any cost already incurred by the Company.

4.3. Refund Timelines
Approved refunds shall be processed within 7–14 business days, subject to banking and payment-gateway timelines.
The Company shall not be responsible for delays beyond its control.

4.4. Non-Refundable Charges
Without limitation, the following shall not be refundable:
(a) registration fees, subscription fees, convenience fees;
(b) payment gateway charges;
(c) partially availed or partially completed services;
(d) any service where value has been rendered in whole or in part;
(e) promotional credits, trial services, or discounted packages.

5. No Warranty & Limited Liability

5.1. The Company does not warrant the accuracy, completeness, or suitability of third-party services, data, or listings available on the Platform.
5.2. Under no circumstances shall the Company be liable for:
(a) service delays, non-performance, or misconduct by third-party service providers;
(b) business losses, revenue loss, or expectation damages;
(c) indirect, incidental, punitive, or consequential damages;
(d) errors or disruptions due to force majeure or technical issues.

5.3. The Company’s total cumulative liability, if any, shall not exceed the amount paid by the User for the specific service, and only where refund eligibility is clearly established under this Policy.

6. Chargebacks & Disputes

6.1. Unwarranted chargebacks or payment reversals shall be treated as a breach of the Terms & Conditions.
6.2. The Company reserves the right to suspend User access, block accounts, initiate recovery, or take legal action in such cases.
6.3. Chargebacks raised after partial or complete service consumption shall be deemed invalid.

7. Force Majeure

The Company shall not be liable for any delay, interruption, or inability to perform its obligations due to events beyond its reasonable control, including technological failures, network outages, acts of nature, governmental restrictions, strikes, or third-party disruptions.

8. Governing Law & Jurisdiction

This Policy shall be governed by the laws of India. Any disputes arising out of this Policy shall be subject to the exclusive jurisdiction of the courts situated at New Delhi

This Refund and Cancellation Policy (“Policy”) forms an integral part of the Terms and Conditions governing the use of the Unaati platform, website, and related services (“Platform”). By accessing, browsing, or transacting on the Platform, the User acknowledges and agrees to be bound by the terms set forth herein.

1. General Principles

1.1. CBV Ventures Private Limited (“Company”, “we”, “us”, “our”) provides digital, advisory, facilitation, and value-added services through the Platform.

1.2. All purchases, subscriptions, credit purchases, service bookings, or transactional activities conducted on the Platform shall be governed exclusively by this Policy.

1.3. The Company reserves the absolute right to amend or modify this Policy at any time, without prior notice, and such revised Policy shall be binding upon publication on the Platform.

2. Cancellation by User

2.1. Digital Services / Subscriptions:

Once a digital service, SaaS plan, subscription, credit package, lead package, or digital deliverable is purchased, no cancellation shall be permitted owing to the nature of on-demand digital fulfillment.

2.2. Service Bookings / Facilitated Services:

Where the Platform enables Users to request third-party or partner-led services, cancellation shall be permitted only until such time as the service has not been assigned, processed, or commenced.

Any cancellation request must be submitted through the Platform’s support channel. The Company retains full discretion to accept or reject cancellation requests based on service status, contractual obligations with partners, and other operational factors.

3. Cancellation by the Company

3.1. The Company may cancel a User’s order, request, subscription, or service booking under the following circumstances, without limitation:

(a) fraudulent or suspicious activity;

(b) incomplete or inaccurate information provided by the User;

(c) non-payment or payment failure;

(d) technical or operational constraints;

(e) breach of the Terms and Conditions.

3.2. In such cases, where applicable, the Company may, at its sole discretion, initiate a refund as per Clause 4.

4. Refunds

4.1. General Rule – No Refunds for Digital Services

Payments made for digital, advisory, subscription-based, SaaS, or platform-generated services are non-refundable under all circumstances, as these services are activated and consumed instantly.

4.2. Refunds for Third-Party Services

In cases where a cancellation is accepted before service initiation, a partial refund may be issued after deduction of administrative, transactional, or partner-related charges. The quantum and eligibility of refund shall be determined solely by the Company.

4.3. Refund Method & Timeline

Approved refunds shall be processed to the original mode of payment within 7–14 business days, subject to banking and payment-gateway timelines.

The Company shall not be liable for delays attributable to external payment intermediaries.

4.4. Non-Refundable Components

Without limitation, the following shall be strictly non-refundable:

(a) platform fees, subscription fees, or service activation charges;

(b) convenience fees, transactional charges, or payment gateway fees;

(c) partially availed or partially delivered services;

(d) any service where value has been rendered in whole or in part.

5. Modification of Services

5.1. The User acknowledges that service attributes, features, or offerings may evolve, and that modifications made by the Company shall not constitute grounds for refund.

5.2. Requests for service modification, rescheduling, or substitution shall be evaluated on a case-by-case basis and may attract additional charges.

6. Chargebacks & Disputes

6.1. Initiating unwarranted chargebacks, payment reversals, or disputes shall be deemed a breach of the Terms and Conditions.

6.2. The Company reserves the right to suspend access, block accounts, or pursue legal or recovery action in such cases.

6.3. Any chargeback raised after service consumption shall be null and void.

7. No Liability for Third-Party Delays

7.1. The Company shall not be liable for delays, deficiencies, or failures arising from third-party partners, service providers, payment gateways, or external entities beyond its reasonable control.

7.2. Such circumstances shall not entitle the User to a refund unless expressly approved by the Company.

8. Governing Law & Jurisdiction

8.1. This Policy shall be governed by and construed in accordance with the laws of India.

8.2. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts at New Delhi to the exclusion of all other jurisdictions.
